2 RELATING TO A COUNCIL ON INDIAN AFFAIRS; AMENDING CHAPTER 40, TITLE 67, IDAHO
3 CODE, BY THE ADDITION OF NEW SECTIONS 67-4004, 67-4005, 67-4006 AND
4 67-4007, IDAHO CODE, TO CREATE A COUNCIL ON INDIAN AFFAIRS AND TO PROVIDE
5 FOR APPOINTMENT OF MEMBERS, TO PROVIDE FOR ORGANIZATION OF THE COUNCIL, TO
6 PROVIDE FOR COOPERATION BETWEEN GOVERNMENTS AND TO PROVIDE POWERS AND
7 DUTIES OF THE COUNCIL.
8 Be It Enacted by the Legislature of the State of Idaho:
9 SECTION 1. That Chapter 40, Title 67, Idaho Code, be, and the same is
10 hereby amended by the addition thereto of a NEW SECTIONS , to be
11 known and designated as Sections 67-4004, 67-4005, 67-4006 and 67-4007, Idaho
12 Code, and to read as follows:
13 67-4004. COUNCIL ON INDIAN AFFAIRS CREATED -- APPOINTMENT OF MEMBERS.
14 There is hereby created the Idaho council on Indian affairs which shall con-
15 sist of ten (10) members, one (1) to be appointed by the governor, two (2) to
16 be appointed by the president pro tempore of the senate from the members of
17 the senate; two (2) to be appointed by the speaker of the house of representa-
18 tives from the members of the house; and five (5) tribal members to be
19 appointed by each Indian tribe with one (1) member to represent each of the
20 various Indian tribes of the state. The five (5) Indian members shall each be
21 members of their respective tribal councils and appointed by the tribal chair-
22 men subject to the consent of the tribal council. A tribal member shall serve
23 at the will of his or her tribal government until a successor is similarly
24 selected.
25 67-4005. ORGANIZATION OF COUNCIL. The council shall meet twice a year and
26 may be called for special meetings from time to time by a majority of the
27 council members. The council shall elect a chairperson and a vice chairperson
28 and other officers from its members. Six (6) members constitute a quorum. The
29 members of the council appointed by the governor shall be compensated as pro-
30 vided in section 59-509(h), Idaho Code. Legislative members of the council
31 shall be compensated as provided by the citizens' committee for legislative
32 compensation for interim legislative meetings which shall be paid from the
33 legislative account.
34 67-4006. GOVERNMENTS TO COOPERATE. The tribal governments and the state
35 government together with its political subdivisions shall cooperate to provide
36 relevant information and assistance on any matters requested by the council
37 and shall share the burden of operational expenses and staffing. Staffing and
38 other costs incurred by the council shall be paid one-half (1/2) by the state
39 government and one-half (1/2) by the tribal governments.
40 67-4007. POWERS AND DUTIES OF THE COUNCIL. The council shall have the

1 following powers and duties:
2 (1) To monitor and review legislation and state policies which impact
3 state/tribal relations in the areas of jurisdiction, governmental sovereignty,
4 taxation, natural resources, economic development, and other issues where
5 state government and tribal government interface;
6 (2) To advise the governor, legislature, and state departments and agen-
7 cies of the nature, magnitude, and priorities of issues regarding state/tribal
8 relations;
9 (3) To advise the governor, legislature, and state departments and agen-
10 cies on, and assist in the development and implementation of, cooperative pol-
11 icies, programs, and procedures focusing on the unique relationship between
12 tribal and state government;
13 (4) To establish advisory committees on special subjects or projects;
14 (5) To cooperate and/or facilitate contracting between tribes and indi-
15 viduals or state, local, and other agencies, including agencies of the federal
16 government and of other states;
17 (6) To make bylaws for its own governance and procedure consistent with
18 the laws of the state and the respective tribes.

STATEMENT OF PURPOSE

This Legislation adds new sections to the State-Tribal Relations
Act, Title 67, Ch. 40 IC. It creates a 10-member council on Indian
Affairs consisting of five members representing the five tribal
governments in Idaho and five members from state government. Of the
state representatives, one is appointed by the Governor, two by the
Senate and two by the House. The representatives selected by the
tribes are each to be a member of their respective tribal council
and appointed by the tribal chairman, subject to the consent of the
tribal council.
The tribal governments and the state government will share the
burden of operational expenses and staffing. The council would
monitor and review legislation and state policies which impact
state/tribal relations and advise the Governor, legislature, and
state agencies with respect to issues involving state and tribal
relations.
FISCAL NOTE
Approximately $4,000 for the State's share of expenses, staffing and
per diem compensation for legislative members of the council.
