1 AN ACT
2 RELATING TO FISH AND GAME; AMENDING CHAPTER 1, TITLE 36, IDAHO CODE, BY THE
3 ADDITION OF A NEW SECTION 36-124, IDAHO CODE, TO PROVIDE FOR RECIPROCAL
4 LICENSURE AGREEMENTS WITH CERTAIN INDIAN TRIBES.
5 Be It Enacted by the Legislature of the State of Idaho:
6 SECTION 1. That Chapter 1, Title 36, Idaho Code, be, and the same is
7 hereby amended by the addition thereto of a NEW SECTION, to be known and des-
8 ignated as Section 36-124, Idaho Code, and to read as follows:
9 36-124. RECIPROCAL LICENSURE AGREEMENTS WITH INDIAN TRIBES. The commis-
10 sion is authorized to enter into a reciprocal licensure agreement with any
11 federally recognized Indian tribe that possesses a reservation within this
12 state. Pursuant to such a reciprocal licensure agreement, the commission may
13 recognize licenses or permits issued by the tribe for the hunting, angling or
14 trapping of wildlife as satisfying license or permit requirements imposed by
15 the commission on such activities and the tribe may recognize licenses or per-
16 mits issued by the commission for the hunting, angling or trapping of wildlife
17 as satisfying license or permit requirements imposed by the tribe on such
18 activities.
STATEMENT OF PURPOSE
RS 12395
This bill authorizes the Idaho Fish and Game Commission to enter
into reciprocal licensure agreements with federally recognized
Indian tribes possessing a reservation within the State of Idaho.
These agreements would allow persons holding either a state license
or a tribal license to hunt, fish or trap wildlife in designated
areas. The Department of Fish and Game, Indian Tribes, and the
public will benefit from reduction of confusion over dual licensing
authorities in these areas.
