1 AN ACT
2 RELATING TO THE RURAL ECONOMIC DEVELOPMENT AND INTEGRATED FREIGHT TRANSPORTA-
3 TION PROGRAM; AMENDING SECTION 49-2902, IDAHO CODE, TO PROVIDE THAT AT THE
4 BEGINNING OF EACH STATE FISCAL YEAR THE DIRECTOR OF THE DEPARTMENT OF
5 AGRICULTURE SHALL DESIGNATE ONE OF HIS APPOINTEES TO THE INTERAGENCY WORK-
6 ING GROUP AS COCHAIRMAN OF THE GROUP, TO MAKE TECHNICAL CORRECTIONS AND TO
7 PROVIDE REFERENCE TO THE DEPARTMENT OF COMMERCE.
8 Be It Enacted by the Legislature of the State of Idaho:
9 SECTION 1. That Section 49-2902, Idaho Code, be, and the same is hereby
10 amended to read as follows:
11 49-2902. INTERAGENCY WORKING GROUP CREATED. (1) An interagency working
12 group is hereby created to advise the department of agriculture on issues and
13 policies in support of the department of 's agriculture's administration of
14 the rural economic development and integrated freight transportation program
15 established in section 49-2901, Idaho Code. The interagency working group
16 shall participate in planning and identifying program needs and shall carry
17 out its duties specified in section 49-2903, Idaho Code. Before recommending
18 state funding, using state dedicated funds, and recommending priorities, the
19 interagency working group shall seek pertinent information, facts and data
20 from state and local governments, and agencies regarding rural freight trans-
21 portation issues.
22 (2) The interagency working group shall be composed of eight (8) members:
23 (a) Four (4) members shall be appointed by the director of the Idaho
24 transportation department, two (2) of whom shall be employees of the Idaho
25 transportation department with a working knowledge of rail and truck
26 freight transportation and intermodal entities, one (1) member, not a
27 state employee, shall represent freight shipping interests, and one (1)
28 member shall be a representative from the local highway technical assis-
29 tance council;
30 (b) Three (3) members shall be appointed by the director of the depart-
31 ment of, agriculture, two (2) of whom shall be employees of the department
32 of agriculture with a working knowledge of economic development issues,
33 and one (1) member, not a state employee, shall represent business devel-
34 opment and financing interests; and
35 (c) One (1) member shall be appointed by the director of the department
36 of commerce and labor and shall be an employee with knowledge of rural
37 economic development issues.
38 (d) At the beginning of each state fiscal year, the director of the
39 Idaho transportation department shall designate one (1) of his appointees
40 as cochairman, and the director of the department of commerce agriculture
41 shall designate one (1) of his appointees as cochairman.
42 (e) Each member appointed shall serve at the pleasure of the appointing
43 authority, provided however, the service of state employee members shall

1 run concurrently with their state employment. Nonstate employee members
2 shall serve one (1) term of five (5) years, but may be appointed to serve
3 nonconsecutive terms, and shall be reimbursed according to the provisions
4 of section 59-509(b), Idaho Code.
5 (f) The interagency working group shall meet at such times as necessary
6 and appropriate to review applications for funds distributed pursuant to
7 the provisions of this chapter, but not less frequently than annually.
8 (3) The department of agriculture shall determine and provide for amounts
9 appropriated to the fund, a one-time amount not to exceed three percent (3%)
10 for planning and operating expenses and staff assistance and support from the
11 department of agriculture and the Idaho transportation department in order to
12 administer the program, and to administer the fund established in section
13 49-2904, Idaho Code.
STATEMENT OF PURPOSE
RS 17376
This legislation amends the interagency working group of the
integrated freight transportation program. The 2007 legislature
moved the program to the department of agriculture. The
director appoints three out of the eight members of the working
group. This legislation provides for the director of the
department of agriculture to designate one of the cochairmen.
